By using Brakeaway.bike ("Brakeaway," "we," "our," or "the Service"), you acknowledge and agree to the following Limited Liability Disclosure:

1. Age Requirement

The Brakeaway service is intended only for individuals 18 years of age or older.
By accessing or using the Service, you confirm that you are at least 18.

2. No Guarantee of Safety

Brakeaway provides route analysis, safety insights, and recommendations based on public, historical, and third-party data. These insights are estimates and confidence indicators only and do not reflect real-time conditions.

Brakeaway cannot guarantee:

that any route is safe,
that any route is free of hazards,
that traffic conditions will be predictable,
or that use of the Service will prevent accidents, injuries, or death.

The safety confidence value expresses Brakeaway's estimate of relative route safety based on available infrastructure data. It is not a certification, a warranty, or a prediction of any specific outcome.

3. Cycling Involves Serious Risk

Cycling inherently involves significant dangers, including but not limited to:

collisions with vehicles, cyclists, or pedestrians,
road defects, debris, potholes, construction zones,
limited visibility, weather hazards, equipment failure,
loss of control, falls, and impact injuries.

These risks can result in severe injury, permanent disability, or death.

By using Brakeaway, you voluntarily assume all risks associated with cycling, whether or not identified by the Service.

4. User Responsibility

You agree that you alone are responsible for:

choosing your routes,
judging safety conditions,
following traffic laws and local regulations,
wearing proper protective equipment,
riding carefully and attentively.

Brakeaway is a reference tool—not a navigation system—and should not be your sole source of safety or routing decisions.

5. No Professional or Safety Advice

Information provided by Brakeaway does not constitute professional safety advice, engineering recommendations, legal guidance, or traffic instruction.

The Service provides informational data only. You are responsible for using independent judgment in all cycling decisions.

6. Limitations of Data

Brakeaway may rely on:

public datasets,
third-party mapping APIs,
user-submitted routes,
historical or non-real-time information.

These data sources may be inaccurate, incomplete, outdated, or unavailable. Brakeaway does not control or guarantee the accuracy of third-party data.

7. Limitation of Liability

To the maximum extent permitted by law, Brakeaway, its owners, creators, partners, and contributors are not liable for:

injuries, accidents, damages, losses, or death,
direct, indirect, incidental, or consequential damages,
property damage or equipment loss,
reliance on route safety scores, safety confidence values, recommendations, or analysis.

Your use of the Service is entirely at your own risk.

8. API and Third-Party Integrations

Brakeaway offers programmatic access to its route analysis and safety confidence output through Application Programming Interfaces ("APIs"). This section applies to any person or entity ("API Partner") that accesses the Service via API and to end users who receive Brakeaway output through an API Partner's product.

8.1 Informational Purposes Only. All output returned through the API — including safety confidence values, per-segment breakdowns, infrastructure classifications, risk flags, and any derived indicators — is provided for informational purposes only and is not a substitute for local judgment, professional advice, or real-world verification of route conditions. API output is an estimate based on public infrastructure data and does not constitute a guarantee, warranty, certification, or prediction of any specific safety outcome.

8.2 Not a Recommendation Engine. Brakeaway's API returns analytical data. It does not recommend, endorse, or approve any route for any specific rider, activity, or condition. Any decision to present, recommend, promote, or surface a route to an end user is made solely by the API Partner and is the API Partner's responsibility.

8.3 Partner Representations. API Partners agree not to:

represent Brakeaway output as a guarantee, certification, or warranty of safety;
describe a route as "safe," "certified safe," "approved," or equivalent language based solely on Brakeaway output;
remove, obscure, or misstate Brakeaway's informational disclaimers when surfacing scores or confidence values to end users;
use Brakeaway output as the sole basis for any safety, insurance, medical, or fitness determination.

8.4 End-User Disclosure. API Partners that surface Brakeaway output to their own end users agree to display, at or near the point at which a safety confidence value or derived indicator is shown, a plain-language disclosure to the effect that the value is informational and not a substitute for the rider's own judgment of local conditions.

8.5 Data Freshness and Availability. The API relies on live third-party data (including OpenStreetMap and elevation providers). Coverage, tag quality, and availability vary by geography and by time. Brakeaway may return default or partial values during upstream outages, and may re-score routes as data becomes available. API Partners are responsible for handling latency, retries, missing data, and cached values in a manner appropriate to their product.

8.6 Rate Limits and Fair Use. API access is subject to rate limits, quotas, and fair-use policies communicated to API Partners. Brakeaway may throttle, suspend, or terminate access to preserve the stability of the Service.

8.7 Partner Indemnification. To the maximum extent permitted by law, each API Partner agrees to indemnify, defend, and hold harmless Brakeaway, its owners, creators, partners, and contributors from and against any claims, damages, losses, or liabilities (including reasonable attorneys' fees) arising out of (a) the API Partner's product or service, (b) the API Partner's representations to its end users, (c) the API Partner's misuse of Brakeaway output, or (d) any breach of this Section 8.

8.8 No Emergency Use. The API is not designed or intended for use in emergency-response, life-safety, medical-decision, or real-time collision-avoidance systems. API Partners must not integrate Brakeaway output into any product where a failure, delay, or inaccuracy of the output could reasonably be expected to cause injury or death.

Summary in one sentence: Brakeaway's API returns an informational safety confidence estimate; it is not a substitute for the rider's judgment, and any partner surfacing it to end users must say so clearly.

9. Agreement

By using Brakeaway, you acknowledge that:

you have read and understood this Limited Liability Disclosure,
you accept all associated risks of cycling,
you release Brakeaway and its affiliates from liability to the fullest extent allowed by law.
